Christian Dior Essay

The House of Dior – A fashion house that over six decades is still going strong. From a humble beginning to a power house of fashion, this house of fashion has begun a â€Å"New Look† for their market during the start if it’s business and beyond. With avant-garde designs, Christian Dior has changed women’s fashion in his era. Starting a fashion business is no mean feat. One may need all the preparation and planning in order to be successful and have your creations reach the market. The House of Christian Dior Christian Dior, a Frenchman, started his career in the 1930’s by selling his sketches to numerous prospective clients. Soon his market was in love with his sketches and designs and that deemed his creations as a â€Å"New Look†. With such creations, Christian Dior needed financial support that was when he got Marcel Boussac (a textile manufacture) to back him up to open his own house of fashion. Boussac was able to persuade Christian Dior to have him set up his place along a trendy Paris street, which Boussac was readily able to fund Christian Dior’s endeavours. With such financial support, Christian Dior began to produce creations that were considered avant-garde at that time and he was able to freely create and design whatever he had come up with without any financial difficulty (Bawa, 2002). Christian Dior knew what he wanted in life and that was to be a part of the arts. He loved to draw and sketch and to create masterpieces. This has made him successful; he knew what he wanted to do. For an aspiring entrepreneur, one must know that before they start their own clothing line or fashion business they need to know that this is what they really want to. If not, the outcome would be less successful or become a failure (Amed, 2007). Christian Dior had financial support that one can dream of. For an entrepreneur, they need to have financial stability, business partners, and the like to easily start their business. Without this, it would be a tough challenge to get by to launch a business or even try to start one. When it comes to materials, Christian Dior did not have any problems in having a short supply of that. He had his business partner to thank for and this gave him an advantage to turn his creations into reality (Charleston, 2004). One must take note that during his time it was during the Second World War that textiles were rationed. He took the initiative to have women, not only in Paris, but throughout the whole world to have them feel more feminine. He had that idea and turned it into a reality. Even if his designs and creations were well received by his peers and prospective clients, there were numerous detractors that openly disliked his attitude. They deemed Christian Dior as extravagant due to his designs using fabric up to eighty yards long. One must see that Christian Dior clearly didn’t have a market due to the hardships that the whole world was currently going through. What he did was he created one. It wasn’t merely being in the right time and at the right place, he saw the need that women wanted during his time, and he began to create the solution to that even at the cost of being deemed extravagant and being boycotted by powerful governments of state. Still he persevered and went on with his plan to change the world fashion market. With Christian Dior’s untimely death in 1957, the house of Dior was stopped suddenly in their tracks, but Dior did not leave his house open for attack, he had two competent men under him that can drive his fashion house beyond. Yves St. Lauren stepped in and headed the House of Dior into success with his designs. The house of Dior had numerous changes in the artistic development and currently has John Galiano. Starting a fashion business needs the entrepreneur to be at least five or ten steps ahead and having a fresh outlook and flow of ideas that they want to put into their market. They need to also know the latest trends and fads that the current market has in order to supply what the client wants. Not only having those ideas one must have a very good business plan in order to plan and execute strategies, decisions, and plans of actions when situations arises, especially those that are out of the box scenarios. The bottom line is that one must have passion for what they believe in. They need to believe in what they do is the right thing to do. Without these, starting up a business or even just planning for it would make all attempts useless and unfruitful. References: Amed, I. (2007). Persuasive Speech About Protecting Animals

I am very pleased to be here to address the Animal Welfare Intergroup, and to discuss with you,in particular, the essential rights of animals. Even nowadays, in the most people’s eyes, animals have no consciousness,no thoughts, and no emotions . Therefore, human regard them as inferior species. People empower themselves to imprison the animals,to mistreat them,to eat them, and to kill them. Who gives the rights for human to do that?Human and animals have the same rights to live in the Earth. So today, I should say at the outset that I,like millions of citizens in China will share the view that animal welfare is an issue of very high importance. And I will speak on behalf of our friends, who also live in this planet—the animals. The current condition of many species of animals is very severe and the extinction rate of animals is increasing with an alarming speed. According to the International Union for Conservation of Nature (IUCN),it calculated that the percentage of endang ered species as 40 percent of all organisms in 2008. Destructive human activities have led to the current rate of species extinction, which is at least 100–1,000 times higher than the expected natural rate.Although almost every country has their own laws and there are many organizations in the world to work toward the protection of endangered species. However, the work is far from done. Many countries have relatively effective laws and policies, but there is not a good way to enforce them. Therefore, destroying of habitats, killing and trading of endangered animals, eating of wild animals and mistreat of animals are still happen in the world. Do you know how many sharks died every year because people love to eat shark fins? Do you know what is the feeling of animals to be tested by human?Do you know the disasters of eating wild animals.Let me tell you the amazing data about them. There are more than seventy million of sharks died and people only killed them for their fins. Peopl e cut fins of sharks and put them back to sea. Shark can not live without their fins and their blood flow in water, sinking to the sea flow and slowly to be died. Why people are so cruel that killed sharks and only satisfy for their taste. The medical developed very fast in recently years and animals make a great contribution for medical researches. Does animals want to contribute to human medical development?Absolutely not.And why people force them and test them. Do you remember the SARS happened all over the world in 2004?A great number of people died because infected with this disease and the first one to get this disease because he ate one kind of wild animals. What can we so for animals? We can contribute to nature reserves and other wilderness areas. Habitat preservation is one of the best ways to help protect endangered animals. And we also need to buy environmentally friendly goods. Choose non-toxic cleaners and lawn care items that won't pollute streams, rivers or oceans.Avoi d any products that have been made from threatened or endangered animals. Buy foods and goods that are made from materials that do not harm endangered animals or their habitat. As you can see from this speech today, the suffering has not ended. Endless thousands of poultry. I'm sorry. That's really just kind of starting to distract me. And I got the shoe and the music going, and I couldn't concentrate there for a second. Okay. Outrageous cases of animal abuse that's just been a portion of what you've heard about today.I hope that you can see from the speech today how essential it is for the thousands and thousands and thousands of animals who are suffering endlessly, that an action be taken. Boiling alive. Humane? I don't think so. Being kicked and stomped and thrown against the wall repeatedly until you are dead. Humane? I don't think so. It is essential that we take an action to enforce animal slaughter rules and rites and regulations. Something has to be done for this billion dol lar industry will continue to go on and on without recourse. Please let's make a difference.

Race and Representation Essay Example | Topics and Well Written Essays - 2000 words - 2

Race and Representation - Essay Example At the same time the celebration has its own pit falls as it might retrogress into violence and killing at the slightest trigger. "This is a delicate situation, and â€Å"race† remains fissile material." (Gilroy, 2004, p. 14). There have been many studies centered on most races of the world. But the images of whiteness have not been placed under the microscope as much as other images of race especially that of blackness. The purpose of this study is to make a cursory glance of the images of whiteness that evolved over the years. Representation and study of racial images or stereotypes are having many sensitive issues. The visual representation of racial stereotypes might force people to re-live and freshen old memories, which might jeopardize inter-racial relation. However, academic pursuits cannot be neglected for the sensitivity of a few. In fact the study might throw light on the subliminal foundations for the formation of stereotypes and provide us the escape routes for the mounting racial and ethnic tensions that has resulted in the loss of many human lives. The idea of race itself is questionable, as Appiah has put it: There is nothing in the world that can do all we ask race to do for us†¦. Talk of race is particularly distressing for those of us who take culture seriously. For, when race works-in places where â€Å"gross differences† of morphology are correlated with â€Å"subtle differences† of temperament, belief, and intention-it works as an attempt at metonym for culture, and it does so only at the price of biologizing what is culture, ideology. (Appiah 1992:45) The central thesis of this paper is the essential nature of the image of whiteness as a historical construct developed over many years similar to its foil blackness. This study focuses on the works of Richard Dyer. Whiteness is essentially a body of knowledge, ideologies, behavioral norms, and many practices constructed over the history

Primary Source Focus Questions Essay Example | Topics and Well Written Essays - 500 words

Primary Source Focus Questions - Essay Example Duties that masters and mistresses expected from their servants include retaining honesty and overall morality in the house. According to Mrs. Beeton, one of the most important qualities of a good mistress is her ability to engage her servant. Another quality is informing her friends and relatives of an empty house through friendly domestics and a relatively lasting willpower (Clark 415). Beeton says some of the most typical issues that exist between masters and servants are decadence and somewhat disposed attitudes towards each other. Beeton’s instructions tell modern readers of the radical change in relationships between household owners and their house cleaners within a span of hundred and fifty years. However, the instructions do not portray any contemporary relevance since this culture was completely abandoned during the twentieth century. 1) In The Ladies Paradise, how is the department store personified (i.e. portrayed) and what do you think this says about the new culture of 19th C consumerism? What challenges and advantages did shop-girls like Denise face? The writer gives the department store the features of a monster-like apparatus and personifies it. The book portrays the department store as a â€Å"continual cascade of materials† flowing alongside the rumble of a river (Zola 36). This portrayal of the department stores paints the image of the 1800s Parisian department store by using numerous definitive pictures. These pictures allow Zola to make an unambiguous comparison between what a customer views at the store and what took place behind the curtains. Challenges Denise faced as a shop girl include supporting her orphan siblings by working at the kid’s section of the store and the store’s uninviting working conditions. However, Denise benefited from the â€Å"match of progress† and her immunity to shopping desires (Zola 41). The theory of evolution challenged conventional belief systems by crossing

Small Businesses Essay Example | Topics and Well Written Essays - 3250 words

Small Businesses - Essay Example From this research it is clear that business success or failure is not ultimately the result of fate or random chance, but there are good reasons why a business did well or the other one didn’t. When a business man plans to set up a business, he may have some initial concerns such as which particular business to be started, who are the main customers to be targeted, how much capital to be invested and what market to be concentrated etc. In today’s rigorously competitive market landscape, the main indicator for the success or failure of a business is the ability of the business to meet customers’ specific as well as general requirements and thus to ensure customers’ satisfaction. As Freeman emphasized, no one who starts their own small business plan to fail, but sadly they fail to plan and therefore they fail. No matter whether the business is small or big, developing a well thought about plan and comprehensive strategic planning is critical to setting a bu siness successfully. In the modern business contexts, small businesses represent a good portion of the economy since it 1) provides increased employment opportunities, 2) Requires less gestation period, 3) encourages growth of local entrepreneurship and 4) improves the standard of living of the local people. In the UK alone, it is estimated that there are 3.7 million small businesses and this plays greater roles in its economy. A small scale business is one in which management is mostly independent and usually the manager is the owner, area of the operation is mainly local and ownership is held by an individual or small group of people. The philosophy on educational Essay Example | Topics and Well Written Essays - 500 words

The philosophy on educational - Essay Example The concept of philosophy was influential in helping Myles Horton to start up learning centers for example; in schools people share dreams and interests while living together. This is based on his definition of a democratic society as one with provisions for positive participation by all in equal terms with secure flexibility (Kohl, Myles and Kohl 1905-90). Since he appreciated the value of education he formed different education centers that led to the spread of citizenship schools to most remote parts in the south and thus helping residents mostly Africans to become literate and qualified to vote. This helped in advancing civil rights movements in 1960s by bringing together coal miners and textile workers. Sharing of ideas and use of the knowledge taught enabled people to challenge and face the negative social problems affecting their lives, boosted and advanced of civil rights, helped workers to form trade unions and cooperatives, helped to make homeless people realize, know and achieve their constitutional rights. The value of education helped to fulfill his determination to see the school he envisioned involve, serve and help poor people in employment and ethnic dissension and in finding ways to gain self-esteem, independence and integrity. Horton organized and appreciated immense transformations in political and social philosophy that enabled restoration of economic prosperity and encouraged patriotism and civic responsibility among the people. One does not need to know the answers to people’s problems but that there are a great deal of views and opinions that people can collectively contribute to build the society. This implies that it is quite crucial to discuss problems in a bid to find viable solutions. Highlander concentrated in inviting the poor who needed sponsorship in order to attend the education centers and learn among other things, their rights in order to overcome the oppression and to learn to handle their problems and

Saudi Arabia's Economy Essay Example | Topics and Well Written Essays - 2500 words

Saudi Arabia's Economy - Essay Example It is acknowledged that the oil industry is a major contributor in the GDP of Saudi Arabia. However, one should not lose sight that other sectors also have significant roles in shaping the economy of Saudi Arabia. These other sectors, though currently not as significant as the oil industry have a considerable bearing in the performance of Saudi Arabia. Also, the Hubbert Peak Theory, which foretells the downslide in Saudi Arabian oil production, warns of the possible collapse of the oil industry's which will considerably reduce or even eliminate the significance oil to the country. This paper will look at the economy of Saudi Arabia as a whole. The first part will talk about the country's GDP and its composition. Next, it will tackle the contributing sectors individually mostly concentrating on the oil industry. An assessment of the Hubbert Peak Theory and its opponent will also be done. In general, Saudi Arabia has a robust economy supported by its strong oil industry. Saudi Arabia's economy began to flourish during after 1973, when the price of oil in the world market skyrocketed. This phenomenon made the country one of the fastest-growing economy in the world as it enjoyed a substantial surplus in its overall trade transactions with its partners, rapid growth in imports, and the generation of substantial government revenue that supports the country's development efforts (Background Note 27-28). During 2004, the country recorded a total GDP of $310.2 billion dollars which translates to a per capita GDP of $11,742. It should be noted that in terms of GDP, the country is in a decline. The aggregated GDP average growth during the period of 1975-2000 was -2.2% as opposed to the -4.4 recorded during 1980-2000 (Saudi or Saudi Arabian Economy 5). In spite of the overall decline in the economy, Saudi Arabia is showing signs of slow recovery from the oil price collapse in 1998. Real GDP growth rate during 2004 was seen at 5.2% while experts forecast that Saudi Arabia will expand at an annual rate of 5.7 and 4.8% for the years 2005 and 2006, respectively (Saudi Arabia 2). The oil industry largely contribute to the total GDP of Saudi Arabia. As stated above, oil export revenue accounts for 90-95% of the country's export earnings, 70-80% of the total state revenue and 40% of the total GDP. The largest chunk of the country's GDP is shared by the industry sector which makes up 58.8%, followed by the services sector at 36.5%. The remaining 4.7% is accounted for by Saudi Arabia's agricultural sector (Saudi Arabia 2). The Oil Industry Saudi Arabia controls the largest petroleum reserves in the world which is 26% of the proved total, ranks the largest exporter of petroleum and undeniably plays a significant role in the Organization of Petroleum Exporting Countries (OPEC). According to the Oil Gas Journal, Saudi Arabia possesses 261.9 billion barrels of proven oil reserves in the world including those, which are in the Saudi-Kuwaiti Divided. The country has 80 oil and gas fields though more than half of the total reserves is concentrated in only eight fields which includes Ghawar and Safaniya. Ghawar is considered the largest oil field with an estimated remaining reserves of 70 billion barrels while Safaniya is the largest offshore

The History of Rasselas by Samuel Johnson Essay

The History of Rasselas by Samuel Johnson - Essay Example This paper looks at the various incidences in which Samuel Johnson used satire in the book, The History of Russelas. Johnson in the novel The History of Russelas explores the life of the prince of the Abyssinia kingdom. The book, exploring the differences in the life of the prince in the valley where they had quality life and had access to any manner of luxury and that of the nobles, explores the satirical side of life in a palace. The comparison of the two different lives of the people living in the kingdom draws the irony of the different statuses of people in habiting the society. Although written in the 1880s, the differences in social status of the people in the society were apparent, just they currently exist. In its own diction, satire explores the various issues in the society that appear weird and funny. Out of normality, the family of the king was hidden in a valley, surrounded by mountains and forests. Whether for beautification purposes or for safety, the setting of the h ome was weird. What, with the seclusion form the hustle and bustle of the palace? Away from the people and into the wilderness, a place that did not have people, different kinds of animals inhabiting the region, that freely mingled with the servants of the kingdom. What was the essence of the family being kept far away from the normality of life? It did not make sense. Some may argue that the king found it safer there, while others may hold that the king wanted a peaceful life for his family. For people to live in harmony, they need to coexist together and show true brotherhood and sisterhood. The king chose to put his family in seclusion from the public and the reality of life. How were they supposed to coexist with the rest of the people if they were not used to living with them? They were used to the animals inhabiting the valley, and the usual servants who served them and took care of them from the time of their birth. They were not used to new faces, or new visitors. How were t hey expected to live with the rest of the people the day that they were left out of the valley? The prince was to marry someday, while the daughters would too get married. How were they supposed to find their companions if they did not leave the valley? For twenty six years, the prince never left the valley; he saw no new faces, neither the face of the sun outside the valley. How was he expected to rule the people after taking over from his father as the heir of the kingdom? The actions of the king did not make much sense. His intentions beat logic when a person thinks of the reasons why he chose to provide them with the kind of lifestyles that he deserved. Perhaps he was to get them their life partners. However, how were they to live from the time they were released form the valley? Maybe he intended to get them families and keep them there forever. Whichever plan that he had, the actions of the king did not make sense. The family, whether royal or not should have been left to free ly mingle with the society. Contrary to this, he would have left them walk around the kingdom and see other people and the kind of work and lives that they lived. The prince found the life of living in the valley boring, in contrast to the life of that of the people living outside the valley in the free world. As he grew up, not only did he get used to the music that was being played by

Graphic design and architecture Essay Example | Topics and Well Written Essays - 500 words

Graphic design and architecture - Essay Example Architecture and graphic design are fundamentally linked as communication tools, they may be coupled to create unique modern results, and the theory of design plays a role in cross-over of design elements between the two design disciplines. Architecture and graphic design are fundamentally applied forms of design, or those that work within a pragmatic framework and often designed for commercial applications (Andruchow). The two types of design share a fundamental goal: communication. Architectural design seeks to communicate to the viewer or occupant many different messages, ranging from practical issues such as how to navigate a building to more subjective areas, such as communicating the culture of the buildings intended occupants. Architecture used as a communication tool is particularly evident in modern constructions, such as the Prada building in New York, in which architecture is utilized to convey a brand image. The Prada building provides a unique example of the coupling of elements of graphic design with those of architectural design. The commonly accepted elements of design apply across the fields of design, and the Prada design leverages the elements of line, shape, texture, space, size, value, and color in both a three-dimensional architectural form and a two-dimensional juxtaposition of elements across the architectural form (Tuscaloosa K-12).

Desdemona as a Victim in the Tragedy of Othello Essay Example for Free

Desdemona as a Victim in the Tragedy of Othello Essay Desdemona as a victim in The Tragedy of Othello, the Moor of Venice by William Shakespeare William Shakespeare is widely known for his famous plays, sonnets, and other works including the tragedy. In The Tragedy of Othello, the Moor of Venice, many characters are unjustly victimized. Throughout the play, Othello’s wife, Desdemona, is a victim of many false statements that lead to her ultimate death. In the beginning, Brabantio, Desdemona’s father, believes that Desdemona is a victim under a spell of the Moor Othello. As the play progresses, Othello, who is overcome with jealousy, falsely accuses Desdemona of having an affair with his lieutenant and best friend, Michael Cassio. After acquiring â€Å"proof† that Desdemona and Cassio are having an affair, Othello becomes so enraged to the point that he kills Desdemona. In conclusion, it is pretty obvious that Desdemona is unjustly victimized. In the beginning of the play, Brabantio believes that his daughter, Desdemona, is a victim under a spell of the Moor Othello. Because of this Desdemona has betrayed her father and she is said to be dead to him. Ay, to me. She is abus’d, stol’n from me, and corrupted  By spells and medicines bought of mountebanks; For nature so preposterously to err, Being not deficient, blind, or lame of sense, Sans witchcraft could not. (Oth. 1. 3. 59-64) In this quote, Brabantio tells the Senators that Desdemona is dead to him because she married Othello. He is sure that Desdemona is either being tricked or drugged because there is no way she would make the mistake of not only marrying behind his back, but also marrying a black man. Shawn Smith states that from the moment Brabantio learned of his daughter’s marriage, he was not happy with Othello, accusing him of witchcraft. [Desdemona’s suffering] initially appears in Othello in a formal legal setting when, in the first act, Brabantio initiates a suit against his new son-in-law, accusing him of improperly obtaining the love of Desdemona† (13). During this suit, Brabantio discovers that Desdemona intended to marry Othello and that she was not under a spell; because of this, he disowns his own daughter. She is considered a victim in this situation not only because her father disowns her, but because she was falsely accused of being under a pell her husband created. As the play progresses, the dishonest Iago tells Othello that Desdemona is having an affair with his best friend, Michael Cassio. At first Othello does not believe Iago, but after acquiring â€Å"proof,† he falsely accuses Desdemona of not being faithful. â€Å" . . . She’s gone, I am abus’d, and my relief/ Must be to loathe her† (Oth. 3. 3. 269-270). Because he thinks his wife is cheating on him, Othello believes that his only solution is to hate Desdemona, even though it will tear him apart. Desdemona is a victim in this scenario because she is being falsely accused of cheating on her husband. She can also be considered a victim because of words that she chooses throughout this act. After Othello fires Cassio from his position as lieutenant for being drunk and disorderly on the job, Desdemona promises that she will make sure Othello forgives and forgets. â€Å"He [Othello] now believes that Cassio has despoiled Desdemona, and for that he seeks the cuckolds vengeance. No longer the doubtful, frustrated falconer, he has become the convinced, determined avenger† (Carson 193). Othello is one hundred percent convinced that Desdemona is being unfaithful and he makes a rash decision to no longer be a trustworthy, loving husband, but rather a mean and vengeful man. Because she is stubborn with her words and actions, Othello mistakes her to be in love with Cassio. This does not work out for Desdemona in the end. Othello becomes so enraged and jealous at Cassio and Desdemona that he believes the only solution is to have Cassio killed and kill Desdemona himself. After â€Å"hearing† Cassio being murdered, he makes his way back to Desdemona’s chamber where he plans to strangle her in her sleep. Desdemona wakes up and after asking if she has said her prayers, Othello informs her of his plan. â€Å"Sweet soul, take heed,/ Take heed of perjury; thou art on thy death-bed† (Oth. 5. 2. 51-52). While he is in the act of killing her, Emilia, Desdemona’s attendant and friend, shows up. He lets her into the room and after she discovers the body of her mistress, she questions Othello as to who has murdered Desdemona. Othello replies, â€Å" . . . ‘Twas I that kill’d her† (Oth. 5. 2. 131). Shawn Smith paints a sad picture with his description of the reactions of playgoers and actors of Desdemona’s death. When Othello murders her, the horrible injustice of the act causes both the characters on the stage and playgoers, such as Henry Jackson, to be moved to pity her unmerited suffering† (7). Anyone who reads or watches the play will be moved with such an enormous amount of pity that they can’t help but see Desdemona as a victim under her horrifying husband, Othello. Desdemona can clearly be seen as a victim at the end of the play, not only because of all the false accusations made against her, but because of her murder. Throughout the play, Desdemona is a victim in many situations that lead to her ultimate death. Her father, Brabantio, believes that she is under the spell of Othello and after finding out that she willingly married him, he disowns her. Her own husband is overcome with jealousy made by false accusations and believes that she is cheating on him with his best friend. His jealousy and anger get so out of hand that Othello murders Desdemona in the end, not only because of the rumor, but because of her own words. If Desdemona had not been murdered, she would not be seen as a great victim. Her murder and the events leading up to it show that she is unjustly victimized throughout the entire play.

Comparative analysis of above competitors and proposal for best practice: In case of company information it is clearly revealed that Sports Direct has depicted all sorts of information regarding the company compared to two other companies. A company doing business in the civilized world should give the details of it to get people know about their intention and purpose. So in this perspective Sports Direct is further ahead than other two. In case of customer services JD Sports is very much close to standard. Because all three company has more or less support for customer services but JD Sports has a special section for services even in the site. In case of the third aspect which is customer rights Kitbag has priority over others. Sports Direct and JD Sports provide customers the right to perform basic activities when do some shopping from them, and Kitbag in addition give the right to erase customers personal detail from the company record which relieves the company from some sort of liability in case of any fraudulent activities by third party (hacker). In case product warranty JD Sports is superior to others. The reason is that JD Sports has specific time duration for product warranty with the illustration of refund policy in the site as well. In case of design and easy accessibility JD Sports scores the highest points. Because the texts in the site are fully readable, the product differentiation by gender and age group is transparent enough; all the links are on a finger tip of the customers. So, considering the above analysis and comparison I would like to advise the client to follow JD Sports online business strategy to set up their own business. They should also consider Sports Direct and Kitbag in respect of detail company information and terms and condition, and customer rights respectively. The ultimate target of this new business should be adopting a site which is dynamic, well defined, realistic, clear in view and finally most customer acceptable. Section 2: Company name and Intellectual Property To start a business a name for the company should be chosen. The name should be legally available and registered with proper authority. Before choosing the name the company type should be identified. Here we would suggest to have limited type of company, more specifically private limited company. We would suggest the name as Sports Craft limited company considering all the legal issues and registration regulation. The reason behind choosing this type of company is that, the shareholders are not liable for disaster in business or have limited liability. Other reasons behind the suggestion are of smaller size, shareholder flexibility in terms of number of shareholders, and executive authority formation of the company. As we would suggest a limited type of company, so the name should End with the word limited as Sports Craft Limited Company, The similar name should not be chosen, which is already in the index, The name cant be offensive to the people. If a name sounds same as another company it can be accepted by spelling differently for example, if there is another company name, called Kraft Sports Limited then our suggested name can be accepted, but it is better to select a unique name to avoid objection of other companies and get registration easily. Before applying for registration we would suggest to check the name at companies house website whether it is readily and legally available or not as opposed to similar name. After choosing the name, registering the company with authorised body will come up as a next step to take place. The registration in UK is done through a body named Companies House under the current companies act 2006. Some provisions or clause of companies act 2006 are not enforced so that the act of 1985 is also in force in respective areas. For the registration of the company you may choose to deal directly with the companies house or can go through the different agents those have experienced solicitors and accountants in the field of company formation. To start this registration process you should send off some documents with relevant fee to the companies house. The documents are as follows: A Memorandum of Association which includes the name, established location, and its function in business, it can be available from a law stationery or agent. Articles of Association which include full description of the way of running business (e.g. selling sports goods and providing good service to the customers online), rights and powers of stakeholders and company directors, it can be available from a law stationery or agent. A form 10 after completion which provides the details of company office, name and addresses of directors and secretary of Sports Craft Limited Company. A form 12 after completion which will provide the compliance of the Sports Craft Limited Company to the legal requirement of company formation. If the registered office needs to be in England or Wales the documents should be sent to companies house in Cardiff. These two types of forms are available in companies house as downloadable format. A private company like Sports Craft Limited Company must appoint correct number of directors and secretary according to its article of association and who should be formally qualified. The director of Sports Craft Limited Company should be over the age of 16 and at least one should be neutral to the company. After the company being formed some sort of notification should be sent to the companies house about: Appointing a new officer Resignation of the officer of the company Changes of details of an officer that was provided in Form 10 Changes of registered office address details. After all the necessary checks and examination which will be done by companies house regarding the name and relevant documents an incorporation certificate will be issued towards Sports Craft Limited Company. Advice on the trademark and domain name issues: Trademark is a distinguishable and graphically presented sign that a company can use for the goods or services they provide in respect to differentiate their products from others and is comprised of words, letters, alphanumeric, and also be a logo. Through the trade mark one can protect his/her personal property from infringement. The trade mark of a company can be protected by the Trade Mark Act 1994. If the member of Sports Craft Limited Company have seen a trade mark of a company in Canada and would like to use that as his own company mark, then we suggest to check first whether the Canadian company has the mark registered or not. If it is registered then the chance of having the mark is less. Even if the Canadian company hasnt registered the mark but it has reputation in business, then he can get it protected by the passing off rights. In case of trade mark the principle is Filing First but the not the Using first. If the Canadian company has the trade mark registered and its bus iness is not multinational or limited to Canada then Sports Craft Limited Company will be able to use that mark under the UK Trade Mark Act 1994. The above situation will also be considerable for Sports Craft Limited Company. If Sports Craft Limited Company wants to do business in Canada, then in case of any dispute the Canadian company has to prove that the mark is registered or applied before the application of Sports Craft Limited Company. But if the mark is not registered then Canadian company has to prove his reputation in doing the business in case of goods and services. The above suggestions should be followed by the newly formed company after examining all the possibilities by experts. These are all top level domain names but there is nothing to deal with level to get the name registered. In UK the domain name is registered through Nominate and it is done first come first serve basis. The domain name should be unique in every aspect. Domain name infringement is based on UK Trade Mark Act 1994 where if the mentioned three names are identical to any registered trade mark or any goods and services in any way then it will be called an infringement of domain name. Before choosing any of the names Sports Craft Limited Company has to investigate whether they are already registered or not. Literally it is evident that all three names are registered under the domain name registrar. Although they all are doing different business than Sports Craft Limited Company but due to the principle of uniqueness there is no chance to get those names as domain name. Those companies can make a dispute which will fall under Domain Name Envy where two or more company have similar domain nam e. Sports Craft Limited Company might be given right to have any of those three names if it attains good reputation or it already has the reputation in other business. In that case there is provision for reallocation of domain names and a dispute resolution procedure. There are seven issues concerned with the domain name dispute resolution which are as follows: Did the other party register the domain name before you registered yours? If not then you proceed on registering with any of the three mentioned names. Does either party own a registered trademark? Is the domain name generic? Does the domain include a celebritys name? Does the domain name include a well-known brand? Can you prove bad faith? How long has this been going on? After considering all the above issues you can decide to get a domain name from the three names. If you want to choose the domain name as, www.Sportscraft.com which has similar word like the mentioned others, so it may come under dispute resolution. In this case we would like to remind you about the case of Microsoft VS. MikeRoweSoft, where although Mike Rowe started a business in dissimilar domain name, but the software giant Microsoft made a dispute against him because of resemblance of the name. Section 3: Privacy and data protection Privacy in e-commerce draws the attention of world business people and also the consumers to protect themselves from fraud. Because of the vulnerability in online shopping customer are getting tensed and unwilling to visit any online shopping site irrespective of their shopping habit, which is a threat to e- business. Online fraudulence through malfunction security measures imposed the customers to and businessmen to pressurise the authority for developing regulatory policies for collecting and using of gathered personal data. So the importance of privacy and data protection should not be ruled over while starting an online business. The legal requirements of online business in respect of UK data protection act 1998 can be categorized as follows: The collection of personal data -Get consent from the customers by using a check box -Sending email and text messages for marketing reasons -Making automated calls -Faxing -Sending cookies The above marketing strategy for goods and services requires the prior consent of the customers. The UK e-privacy regulations control these activities with the help of data protection act 1998. Data trafficking Routing of data Duration of keeping the data. Reason behind keeping the personal data for longer period Location data Identification of the customers location Transfers and usage of personal data need to be regulated Fare use of data Adequacy, relevancy, and range of excessiveness of personal data Accuracy and security of personal data while transferring Three main issues in website privacy policy are: Securely and fairly processing of customers personal data Secondary or reuse of data by authorised company and by third party, where transfer of personal data should be restricted. Accessibility in financial information and use of cookies to recognize past customers. Now we would like to advise our client in respect of collecting personal data for business and reutilization purposes. In collecting the personal data the above legal issues or requirements should be fulfilled by the company. In descriptive way we would suggest the company the following: The personal information should be collected for legal and purposeful reason. The collected data should be kept secured and processed fairly which means prevent the third parties to access and carryout the examining of data. The personal information should not be kept for longer than needed unless some exceptions such as investigation for crime, terrorism under the investigatory powers act 2000 or crime and security act 2001 or otherwise for billing purposes. For billing purposes the personal data can be stored for duration of six years. The customers can have the power of erasing their information from the database of the company by using technology. The transfer of information to third party should require consent from the customers. The transfer of personal information should be prohibited to outside business region unless there is enough security and protection of those data. The transfer of data should not be rejected for the reasons of contract formation, public interest, legal proceedings, taxation, national security, and information commissions office authorization. The racial identity information is treated as sensitive personal information which can come under ethnic group. The racial identity information should be kept and processed with more care than the standard personal information such as it must satisfy the fair and lawful processing together with one of mentioning conditions: 1) explicit consent of customers, 2) secure the interest of the customers, and 3) to secure the legality of the information. Section 4: Advertising and marketing: The e-commerce advertisement should have the characteristics of Truthfulness/transparency: Where marketing communication should not be misleading by faulty and ambiguous information. Safe from customer vulnerability: This means the customers should not be motivated or enticed to commit dangerous activities resulting in social unrest. Descent in respect of content: Marketing communication should not contain anything on the platform of racial, religious, sexual orientation and disability. Reality of promotional offer: Where promotional goods and services should maintain the normal quality with mentioning the correct duration, and promoters should not be disappointed in any situation. Fair competitiveness And secured linking. The site design should be clear enough to be understood by the customers. All the products are meant to be available for delivery as advertised for promotion unless any exception included in the terms and conditions. The price content should not include any hidden charges. Direct marketing can be introduced with the legal perspective and customer consent. There is no actual legislation for controlling the content of advertisement. But some rules or code of conduct regulate the e-commerce advertising which are relevant to the trade, marketing and advertising in respective fields. The code of practice provides a self-regulatory environment which can be implemented in accordance with legislation or independently for dispute resolutions. The design of advertisement should comply with the code to rely on the legality, decency, honesty, truthfulness, and consumer confidence for marketing arrangements. The following brief discussion of two UK laws regulating the content of advertisement would provide you some transparent view of advertising online. 1. Trade description act 1968: The trade description act started enforcing since 30th November 1968. With the replacement and extendibility of previous trade legislation the trade description act 1968 enforce the business men providing actual description of goods and services in terms of price, size etc. The Trade Description Act consists of subsections which comply with the trading as follows: A) The business activities by a company can be treated as an criminal offensive action under the Trade Description Act 1968 when the business organization, Present any goods and services in fictitious way in terms of price, size and the quality. Make available such goods for supplying to customers which do not comply with the stated description in advertisement. Provide fake and vague statement of different service facilities to confuse the customers and entice them to buy or use them. B) Describing the trading pattern in terms of products, services, facilities, and the ultimate quality of them include The dimension of the above in sense of size, quantity Production mechanisms such as manufacture, processing Content in terms of which is composed of Quality assurance against the description Results of testing and the approval from respected authority Time duration of the goods and services understandable by the customers. Under the Trade Description Act 1968 any false indication for any sort of goods and services by the trader is a punishable offense. For example the traders are not allowed to present or sell any products with the presentation of any royal family members or any famous person, even if the permission is granted from them. The failure of fulfilling any services stated by the trader is an offense and can be sued by the customers without the involvement of the Act. Spoken statement is outside the reach of the legislation, hence the compensation are not taken into consideration under this Act. Then it can be finalised with the help of civil law if the court thinks it perfect. 2. Misrepresentation Act 1967: The Misrepresentation Act 1967 came in to force in 22 March 1967 by the amendment of two sections of Sales of goods Act 1893. Under this Act the following should be considered: A) If any contract is formed with the misrepresentation of any products then the customers are entitled to cancel the contract without averring the fraudulent activities. B) Where the customers are in a contract by the misrepresentation in advertisement and suffer a massive loss is entitled to claim for damages on the proof of fraudulent misrepresentation and vice versa. C) If a contract is made between two parties with misrepresentation of products subject to accepting any terms and conditions regarding unintentional misrepresentation by the customers, then the traders may not be liable for any damage caused by it as long as it satisfy the section 11(1) of the Unfair Contract Terms Act 1977. D) The trader should not represent any products which can be presumably considered as someone elses product that has reputation or registered trademarks in the market. Conformity of advertisement to those laws: As mentioned above about the design or characteristics of Sports Craft Limited Company advertisement, we would like to relate the Trade Description Act 1968 to a) customer vulnerability, b) promotional offers for various products which should be described in clears view and compliance to the relevant products, c) fair competition in case of accurate information about the products advertised on line, d) price tagging where there should be no hidden charges, and e) secured linking of third party advertisement where the trader describes the products with appropriate information. Also the Misrepresentation Act 1967 can be conformed to the a) truthfulness/ transparency of presenting a particular product, b) decency of content of the site, where representing any violated information can result in social hazards. Advise in regard to direct marketing to athletes: The direct email marketing is a campaign through advertisement to reach the targeted people with the ultimate purpose of selling products and differs from other traditional types of marketing strategy. It can be in a form of digital text, HTML, spamming as unsolicited mail etc. To start the email marketing a number of regulations should be taken into considerations which comply with the unsolicited electronic messages sent through different communication media. The most important condition to consider first is that, the unsolicited electronic marketing is only possible with the permission of recipients in this case the athletes. These conditions are complied with the European Communities Ordinance 2004 and the Data Protection Act 1998 for the communication with individuals and organizations. The exceptions of this regulation are as follow: The unsolicited mail or spam can be sent to athletes if their personal information has been gathered in case of any sale of products take place. In case of marketing similar products In case marketing giving the opportunity to unsubscribe the marketing arrangement by the customers while giving p

Women Of Ancient Greece Essay -- essays research papers

The Women of Greece: A Transition from Ancient Power to Classical Subservience   Ã‚  Ã‚  Ã‚  Ã‚  For the most part, women in today's society hold a position equal to that of a man; however, this has not always been the case. Women?s conquest for political and social freedom is a battle that has gone on for centuries. Perhaps the breaking point in women?s liberation was the Women's Movement of the 1900's, which encouraged women all over America to join in the fight for their right to vote. Because of this struggle for equality, women are now able to vote, receive a standard of fairness in the workplace, hold political positions, and play professional sports, as well as a wide array of other privileges enjoyed by men. Unfortunately, these civil rights have not been made available to women worldwide. In some cultures, especially those of the Middle East, women have gained little if any rights at all since the societies of the past. In Greece, an almost opposite effect can be seen in its history in which women in their country went from being recognized as equals and above, to becoming a much weaker sex. This odd transition of status of Greek women is evident through the art, mythology, and philosophy of a much older Greece. Thus dominant role of women portrayed in Ancient Greek mythology and artwork is in direct contrast to the more subservient role of women during the classical era in Greece.   Ã‚  Ã‚  Ã‚  Ã‚  Ancient Greece, otherwise known as the Archaic period (650-450 B.C.), was a time of great development for Greece. The first major developments in Greece were cities or towns and their surrounding villages called city-states(Greece 366). Much rivalry consisted between city-state residents which resulted in a great deal of patriotism for one?s city-state. Some of the best known city-states are Athens and Sparta (Greece 366).   Ã‚  Ã‚  Ã‚  Ã‚  During this time of growth, numerous tyrants came into control of the city-states. These tyrants caused the people to become bitterly rebellious, which later ended in revolt and the birth of the first known democratic government (Greece 372).   Ã‚  Ã‚  Ã‚  Ã‚  City-states were once again threatened by takeover in the 500?s B.C., when Persian kings tried to overrun the city-states; however, the city-states revolted against the Persian kings. These uprisings did nothing more ... ...n of the Classical period, which is illustrated throughout the artwork. Amazon women (refer to Plate 5), who were depicted as being able to fight with men, were greatly symbolic of women?s power in ancient Greece. In a painting from the House of Dioscurides (see Plate 12), Perseus slays the dragon to free Andromeda, which reveals the woman?s dependency on a man. When comparing artwork of the Classical and Archaic period, one can see the transition that these Grecian women went through.   Ã‚  Ã‚  Ã‚  Ã‚  The struggle that some women have had to face for common rights that are enjoyed by women today is incredible. Many owe thanks, to those that have fought for civil rights so that equality can be enjoyed by everyone. Unfortunately, there are still many countries who suffer from a lack of true freedom. The transition that Greece went through in their attitude towards women is much different than any other cultures, in which women usually gain rights and respect not lose them. The woman portrayed in Archaic art, mythology and philosophy is one of power and grace, while the woman portrayed in Classical art, law and philosophy is one of subservience and weakness.

Charitty Royal :: essays research papers

Charity Royall displays both self indulgence and self control. Judge Royall represented law and structure in her life. He was the one sure thing that she had. He was her only monetary means of survival and without him she would not be were she is or would not have a place to stay, food to eat, or clothes to wear. Then on the other hand there was Lucius Harney, who represented everything else in her life. Excitement, adventure, fun, and finally the ability to fulfill and longtime dream of being with a sophisticated person some one that was not from North Dormer the town that she despised so much.   Ã‚  Ã‚  Ã‚  Ã‚  Judge Royall was the only father figure she ever had. He made a promise to her jail bound father to give Charity a better life. He drove all night to find Charity up in the mountain; she knows that and because of that she feels some what compelled to stay with him so that he is not lonely. â€Å"Charity ‘felt softness in her heart’ in knowing that he drove all night to fetch her from the mountain (266)†. She knows that she runs his household and that he cannot be with out her because all in all she is the only person that he has.   Ã‚  Ã‚  Ã‚  Ã‚   In spite of everything†¦Lawyer Royall ruled in North Dormer; and Charity ruled in Lawyer Royall’s house. She had never put it to herself in those terms; but she had known her power, knew what it was made of and hated it. (p. 146) The same though goes for her. He is the only one that she has. When he was going to send her to boarding school he decides not to send her. After he decides not to send her away at all, Charity, who is always â€Å"sick of North Dormer† (22) is disappointed but finally understand his decision: â€Å"He and she, face to face in that sad house, had sounded the depths of isolation; and though she felt no particular affection for him, and not the slightest gratitude, she pitted him because she was conscious that he was superior to the people about him and that she was the only being between him and solitude. (P.5) This tells the reader that although he â€Å"rescued† her from the mountain that is not why she feels compelled to stay with him. She knows that because she is there physically (she really is not there emotionally) he does not fell alone in the world.

Macbeths Downfall Essay -- essays research papers

In William Shakespeare’s Macbeth, the main character, Macbeth, is a brave and loyal subject to the King of Scotland, but as the play progresses, his character begins to change drastically. Evil and unnatural powers, as well as his own passion to become king, take over his better half and eventually lead to his downfall. The three main factors that intertwine with one another that contribute to Macbeth’s tragic end are the prophecies told by the three witches, Lady Macbeth’s influence, and finally, Macbeth’s excessive passion and ambition which drove his desire to become king to the utmost extreme. The prophecy told by the three witches was what triggers the other factors that contribute to Macbeth s downfall. In the first act, the witches tell Macbeth that he is to become the Thane of Cawdor and soon after, king. This prophecy arouses Macbeth’s curiosity of how he can become the King of Scotland. â€Å"Stay, you imperfect speakers, tell me more: By Sinel’s death I know I am Thane of Glamis; But how of Cawdor? The Thane of Cawdor lives, a prosperous gentleman; and to be king stands not within the prospect of belief.† (Act I. sc.III) This quote shows how the witches prophecy attracts Macbeth. It demonstrated how Macbeth thirsts for an answer from the witches of how is he to become the Thane of Cawdor and even king. As the play continues, Macbeth slowly relies on the witches’ prophecies. It becomes a remedy for Macbeth’s curiosity, which corrupts his character. One of the witche...

Malignant Hyperthermia: What You Need to Know

Malignant Hyperthermia: What You Need to Know Ivy O. Corlew, BSN, RN, CNOR Conneaut Medical Center–OR Malignant Hyperthermia: What You Need to Know What is Malignant Hyperthermia or MH Malignant Hyperthermia (MH) is a rare, life threatening, pharmacogenetic disorder characterized by hypermetabolic state of skeletal muscle induced by inhalation anesthetics like halothane, sevoflurane, desflurane and the depolarizing muscle relaxant agent like succinylcholine (Rosenberg et al, 2007).Clinical signs are; Increased end tidal CO2 production which is an early sign, tachycardia, tachypnea, trunk or total body rigidity, masseter (jaw) muscle rigidity after succinylcholine which occurs commonly in children, marked temperature elevation (maybe a late sign), respiratory and metabolic acidosis, myoglobinuria(MHAUS, 2011). If left untreated the patient will experience cardiac arrest, kidney failure, blood coagulation problems, internal hemorrhage, and possibly death (slideshare, 2010) Nursi ng AssessmentNurses taking care of surgical patients must be knowledgeable regarding MH so they can identify clinical signs and symptoms early on, its emergent treatment, and be able to respond promptly and appropriately. Preoperative assessment by nurses are crucial in identifying the patient, who could be at high risk for Malignant Hyperthermia, so MH triggering agents can be avoided during anesthesia. Example of questions to ask to help screen for MH susceptibility are (AORN 2012): 1. Has anyone ever told you that you had a â€Å"bad† reaction to anesthesia? 2. Has anyone ever told you that you or your family member had a problem with anesthesia? . Have you or a family member experienced a high fever while under anesthesia? 4. Has anyone ever told you or a family member they had a difficult time opening your jaw during general anesthetic? 5. Has anyone in your family died unexpectedly in the operating room? 6. Have you or anyone in your family experienced sunstroke or heat stroke resulting in hospitalization? 7. Have you ever noticed dark â€Å"cola-colored† urine after a general anesthetic or after experiencing a heat-related illness? Treating MH Dantrolene IV is the only drug available in the market to treat Malignant Hyperthermia. It is difficult to mix and is time consuming to reconstitute. It comes in yellowish colored powder that when fully mix with non-bacteriostatic sterile water, the color stays the same. The new brand Dantrium IV (dantrolene sodium for injection) mixes in just 20 seconds (MHAUS, 2011). However, this is not what we have stocked in our cart. According to MHAUS (2011), dantrolene suppresses the exaggerated rise in muscle cell calcium that seems to trigger MH by binding to the calcium channel site in muscle that is responsible both for calcium release and, likely, calcium entry into the cell.Dantrolene may cause significant muscle weakness in patients with preexisting muscle disease and should be used with extreme caution in those patients. When used with calcium channel blockers (verapamil or diltiazem), dantrolene may produce life-threatening hyperkalemia and myocardial depression. Once a patient has been successfully treated for 36 hours with intravenous dantrolene, he/she may be switched to oral dantrolene until the CK or Creatine Kinase level is trending down and there is no further evidence of acidosis or hypermetabolism and temperature spikes. A recommended 36 vials be stocked.Treating Malignant Hyperthermia crisis is a complex nature, and it involves several staff members. The first thing to do in the event of suspected MH crisis is to recruit extra staff. The following steps are outline by role (MHAUS, 2011): The surgeon should stop or complete the procedure as soon as possible. The anesthesia provider stops inhalation agents; stops warming blanket; increase minute ventilation; inserts esophageal temp probe; inserts NG tube for lavage as needed; administers dantrolene IV; inserts an arteria l line; draws blood for chemistry, ck, coagulation, ABG.If peaked T waves on ECG, administers calcium then glucose and insulin. If T waves are not peaked and arrhythmia present, injects bicarbonate. The circulating nurse brings in MH cart; mixes dantrolene based on 2. 5 mg/kg with 60 ml of non-bacteriostatic sterile water, repeat dose until the signs are controlled. The circulating nurse should document the event. A second nurse assist in mixing dantrolene and hands syringe to anesthesia provider. A third nurse brings in emergency crash cart; places urinary catheter; assist in drawing blood or with other task.A fourth nurse brings in plastic bags with ice and cold IV fluids; places ice bags on exposed parts like groin, axilla, and neck (without compromising sterility); iced saline lavage of any open body cavities such as the stomach, bladder, or rectum. Cold I. V. fluids are administered using 0. 9% sodium chloride, but Lactated Ringer’s is avoided so that acidosis is not wor sened (Martin, 2009). Stop cooling measures when temperature falls to 38 °C (MHAUS, 2011). A laminated copy of MHAUS dantrolene dosage chart is located on top of MH cart to minimize precious time wasted in calculating dosage per kilogram. As soon as patient is stabilized, transfer patient to ICU or call transfer center for an emergent transfer to UH Case SICU or ED. Knowing your Role All staff involved in the MH crisis response should conduct a debriefing meeting as early as possible. Points to consider including (AORN, 2012): 8. Was the MH cart adequately stocked and immediately available? 9. Were enough staff members available to manage the crisis effectively? 10. When staff members responded, were they familiar with task expected in MH crisis? 11. Was MHAUS appropriately notified? 12. Do staff members have other ideas about planning care for a future MH crisis? 3. Has a root-cause analysis been done (MH is considered a sentinel event)? Staff Competency By using the mannequin as our patient, and mixing the expired dantrolene from MHAUS, perioperative staff did fairly well during the MH mock drill simulation by following thru with the expected roles. MH drill should be held at least quarterly to help perioperative staff practice early recognition of MH crisis and how to act accordingly. MH drill also improve OR (operating room) team coordination and provides opportunities to serve in each of the four roles mentioned (Martin, 2009). PreventionEarly detection of clinical signs and symptoms of MH, knowing your role and a prompt response to this emergent crisis can save your patient’s life. MH crisis prevention is the key and the best treatment you can provide to your patient. Knowledge about MH is a must for nurses taking care of a patient before, during and after operative care. Armed with this knowledge, you can make a difference in your patient’s lives. References AORN (2012). AORN Malignant Hyperthermia Guideline.
